Red Light Camera Photographic evidence?
The lights were on amber as i approached them.
They must have turned to red as i went through them.
I requested and received the photographic evidence.
The first picture shows the red light as active for 1.64 seconds with my back wheel just on the stop line
The second picture was taken 0.5 seconds later.
It was a bit misty on the day and my registration plate is unreadable from both these photos.
However, they also included a third photo.
This being a “blown up” shot of the second photo and the letters on my number plate being darkened and sharpened
as the rest of the car is still “foggy”
Is this third photo admissible in court ???
or are they only allowed to use the actual footage from the RLC with no “enhancements”
Also, if i return the completed NIP
am i admitting that it was my car being photographed
The enhancement is purely to identify the car and clearly you are not denying it. And to be honest to have driven even 1.64 seconds over a red light is an offence. Personally I would always regard an amber light as stop and nothing else unless it changed to amber while I am crossing the line. You appear to have chanced your luck here and the inevitable happened. And unlike speed cameras, that we all hate with avengeance, a red light camera is there to prevent avoidable crashes at road junctions and should be commended. Far too many people cross on red and usually at a fair speed and with no thought for a possible victim to crash into. From what you say, if the only argument you have is that the car was poorly identified, or identified through ‘questionable’ means, then you have really have to put your hands up here. I don’t see you denying anything here ..?
